Terms of Service

1. Acceptance of Commercial Terms

These Terms of Service (“Terms”) establish the legal framework governing all sourcing, procurement, export management, and logistics advisory services provided by Mighty Merchant Exim (“Company”). By issuing a purchase inquiry, executing a trade contract, or authorizing shipment dispatch, the client (“Buyer”) agrees to be bound by these Terms.

2. Scope of Agency Services

Mighty Merchant Exim operates as an institutional Exim partner and sourcing agency providing:

• Supplier Verification: Physical factory audits, machine capacity verification, and business license checks across Indian manufacturing hubs.
• Commercial Negotiation: Direct factory open-book pricing, contract drafting, and payment schedule alignment.
• Quality Control (QC): Pre-shipment batch testing, lab sampling, container loading supervision, and phytosanitary verification.
• Freight & Customs Brokerage: Export clearance, port dispatch coordination, and ocean/air bill of lading processing.

3. Commercial Pricing & Payment Terms

All quotes are issued under Incoterms 2020 guidelines (FOB Indian Port or CIF Destination Port as agreed). Payment parameters are structured as follows:

4. Quality Control & Specification Tolerances

Product specifications approved in pre-production sample accreditation forms constitute the binding quality benchmark. Batch sample variations within industry-standard tolerances (e.g. ±1.5% moisture rating in agricultural goods or ±2% color variance in handloom fabrics) shall be deemed acceptable unless strict zero-tolerance parameters are specified in writing prior to production.
